The Pwnit! team and community celebrate and reward our user’s amazing gaming moments. We provide you a platform to share your skills, connect with like-minded players, and win prizing by uploading media in the form of video (“Clips”) and images (“Screenshots” or “Screens”). This process involves posting Clips, Screens and descriptive information, including the tags associated with uploaded media. Such postings are governed by our Terms of Service.
Please note that any information that you post on the Site may appear on other websites when shared or when searches are executed on the subject of your postings. If you post your real name, email, or game service identities, you may receive unsolicited messages on those services so we encourage you to exercise discretion and caution with respect to your personal information and the personal information of others.
By providing personal information you consent to its use in accordance with this Statement and, if you live outside the United States., you consent to the transfer of such information to and processing such information in, the U.S. This policy covers only the data collection and use practices on the Site. Pwnit! does not collect personally identifiable information unless our visitors voluntarily provide such information to us. We ask for personal information in certain circumstances, such as when you register your account, upload media, or submit media you’ve uploaded to Ladders. The following sections describe what type of information we collect, when we collect it and how we use it.
In order to access certain services, content, or features, you will be required to create an account with Pwnit!. When you register and create an account, we require you to provide us your name, date of birth, and email address as well as a user name that you select. You may also register for Pwnit! by utilizing third party single sign-on services available through your pre-existing social networking accounts, such as Facebook or Twitter.You may be able to register this way will allow you to more easily find friends, develop Allies and share your best moments. Specific data points, or “Attributes” such as your first name, last name, email, and age are collected by Pwnit! at the time of Registration.
Once you register you can provide other information about yourself, such as your gender, current city, and mailing address. You can also provide information about your preferences.
If you win a prize, we will need your physical address and telephone number to process and distribute your prize. We also require this information comply with applicable laws. related to such activities.
Ally Features and Information
We utilize third party services to help you connect your friends to the Site for the purpose of developing “Allies.” These services will invite your contacts to join. We will not store your login, password, or contacts from these third parties.
Pwnit! allows users to connect to various third parties platforms, such as social media services like Facebook, Twitter, Google, AOL, Microsoft or Yahoo! using sharing features. Your sharing of information and other communications using those networks are governed by their respective privacy policies.
From time-to-time, we request information from users via surveys. Participation in these surveys is completely voluntary and users have a choice whether or not to disclose the requested information. Information requested may include contact information (such as your email address), and demographic information (such as interests or age level). Survey information shall only be used for our internal use and will not be transferred to third parties (except to process such information) unless specifically indicated.
We keep track of some of the actions you take on Pwnit!, such as when you provide information or content to us, when you Upload media or Submit media to a Ladder.
In addition, we may collect other information about your usage of Pwnit!, such as: times you sign-in to and sign-off from Pwnit!; games that you have uploaded media for; and content you view, vote, and win from Pwnit! We keep track of some of the actions you take on the Pwnit! website, such as adding friends as Allies or following your favorite developers, publishers, brands and games.
As with most web sites, we collect information about our user’s use of the Site through passive data collection means. This may include geographic information based upon your IP address, operating system, browser name/version, the referring web page, requested page, date/time, and sometimes a "cookie" (as described in greater detail below) which can be disabled using your browser preferences) to help us remember your visit history to the Site. If you are logged in, this information is associated with your personal account. The information is also included in anonymous statistics to allow us to understand how visitors use our Site.
We provide customer service support through email and feedback forms. In order to provide customer support, we may ask for certain information regarding your account, such as verifying that you are the account owner. Aside from this information, we do not ask for any personal information to provide customer support. We only use information received from customer support requests, including email addresses, for customer support services and we do not transfer or share this information with any third parties.
Information Collected by Third Parties
In an attempt to provide increased value to our visitors, we may choose various third party web sites to link to, and frame within, the Site. Beacons & Analytics
We automatically collect your login,e-mail address, and the Internet protocol (IP) address used to connect your computer to the Internet; we also automatically collect non-personal information from you, including but not limited to the following types of information: computer and connection information such as browser type and related browser data; content viewed; and purchase history, which may be aggregated with other information for analytic purposes.
Some of our web pages, e-mail messages, and/or newsletters may contain electronic images known as web beacons, which are also called single-pixel gifs. Web beacons are not used to access your personally identifiable information, but they are a technique we use to compile aggregated statistics about the usage of our web sites and to track the number of users who have opened and acted up our messages. Sharing Information Responsibly
Pwnit! is designed to make it easy for you to find great content and connect with other gamers. Your profile itself is available for viewing by anyone, but certain parts of your profile, such as your location may be hidden from view. You may or may not want to meet new teammates and opponents or check out Winners’ skills head-to-head both online or offline.
Each online gaming service is unique and it is up to you to manage your account on third party services. Pwnit! is not responsible for the consequences of such disclosures including, but not limited to, unsolicited communications.
Profile settings control who can see your general location. You do not have to share this information publicly.
Directly and indirectly through clips, screens and comments you and other Users upload and post your gaming identities, and are thus sometimes visible. When other Users tag you in their uploaded media you opt-in to being visible and associated with content.
Even after you remove information from your profile or deactivate your account, copies of that information may remain viewable elsewhere to the extent:

※ Partners featured your content as a Spotlight
※ It has been shared with others
Understand that information might be re-shared or copied by other users and certain types of communications that you send to other users cannot be removed.
We may use the information we collect to tailor your experience through the Site by displaying content according to your interests and preferences, providing a faster method for you to access your account and submit information to us and allowing us to contact you, if necessary.
We may contact you with maintenance announcements and marketing messages from time to time. You may opt-out of all communications (except essential updates and maintenance announcements) on your Settings or by following directions in such messages. In order to opt out of receiving email notifications and updates, please access your Profile and select the appropriate options.
We use your profile information and your media uploading information to make suggestions about other games you may like to play.
We allow other users to use contact information they have about you, such as your email address, to find you, including through contact importers and search.
We may provide aggregated information about our visitors to outside parties from time to time.
We share statistical and demographic information about our users and their use of the Site with suppliers of advertisements and programming. This may include information inferred from your IP address but does not include anything that could be used to identify you or to discover individual information about you
Additionally, you may elect to export your user activity feeds to other networks such as Facebook or Twitter, which may be subscribed to by other users, which may include information regarding your game play and other information about your account activity which is published on the Site.
We implement a variety of security measures to ensure the security of your personal information on our systems. User personal information is contained behind secured networks and is only accessible by a limited number of employees who have special access rights to such systems. We continue to store your personal information for so long as it is necessary to provide you our service and currently do not anticipate destroying old personal information. In most cases, we will at a minimum keep one archival copy of your information to allow us to comply with laws or respond to legal processes.
To update, modify or delete the information that we have on file for your account, simply go to your Profile and “Edit” your details and settings as necessary.
If you want to stop using your account you may deactivate it. When you deactivate an account, no user will be able to see it, but it will not be deleted. We save your profile information in case you later decide to reactivate your account for up to one (1) year. For up to one (1) year you will still have the ability to reactivate your account and restore your profile in its entirety. We retain aggregate non-personal information associated with your activity through the duration of your account usage.
Change of Control
Under California law, California residents may request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.
